We assist companies at each stage: (1) providing legal context for, and elimination of, harassment and discrimination; (2) discussing implicit bias, recognizing and appreciating differences, and fostering a culture of inclusion and success; and (3) helping consider, formulate, and implement legally compliant diversity, equity and inclusion initiatives, programs, or committees.

Our diverse team is well versed in employment laws and the nuances of both the legal and practical application of these laws in the workplace. Our team provides initial comprehensive harassment and discrimination prevention training, and can also provide exactly what your company needs beyond traditional training. This can include sessions generally deemed to be “sensitivity” training: elimination of bias, sensitivity in the workplace, and understanding other viewpoints. We can also work with companies to discuss the business case for diversity, equity and inclusion, and if they are looking to be more aggressive, we can help companies legally and effectively design and implement diversity, equity, and inclusion programs.

bryan benard
Bryan frequently conducts highly interactive public and in-house seminars, workshops, and trainings on various labor and employment related issues. Bryan regularly represents clients in wrongful termination, harassment, and discrimination claims in both federal and state courts, as well as in administrative proceedings before federal and state agencies.
His employment litigation experience includes jury trial success and significant wage and hour class action success in both Utah and California. He provides sound counsel to clients regarding employee relations, employee contracts, and employee handbooks, with extensive background with non-compete and non-solicitation provisions. He also has national experience in advising employers related to the Americans with Disabilities Act and reasonable accommodations, the Family and Medical Leave Act, the Uniformed Services Employment and Re-employment Rights Act, and the Fair Labor Standards Act. Mr. Benard also conducts workplace investigations into employee complaints and potential harassment.
Bryan has experience with several different industries including temporary staffing agencies, start-up and tech companies, health and medical fields, package delivery industry, oil, gas and mining operations, and mortgage/lending institutions.
mickell jimenez
Mickell represents business owners and management on the full spectrum of employment issues that can impact an enterprise, from offensive guidance, counseling, and strategy to defensive litigation. She provides up-front guidance to help position businesses to effectively mitigate risk and provides training on all aspects of state and federal laws and employment best practices.
When disputes arise, Mickell draws on her substantial experience in state and federal court to defend clients in litigation, administrative and regulatory hearings, and alternative dispute resolution forums.
Mickell brings 20+ years of experience serving as outside General Counsel to certain clients, helping start-ups effectively manage the challenges and opportunities facing nascent businesses, particularly in the food and beverage industry.
engels tejeda
Engels is a trial lawyer who represents businesses and individuals in a range of commercial disputes. He draws on over 14 years of courtroom experience when advising clients on risk mitigation, conducting internal investigations, and shaping effective narratives around hotly contested issues.
A first-generation American, he attended law school in between overseas deployments with the United States Army Reserve, and became one of a handful of black, Latinx, or openly LGBTQ+ partners at an AmLaw 200 law firm in Utah. He has dedicated much of his legal career to addressing issues of diversity, equity, and inclusion within the Utah legal and business communities. Among other initiatives, he leads Holland & Hart’s mentoring partnership with the Utah Center for Legal Inclusion, through which over 20 University of Utah and BYU law students primarily from underrepresented groups are paired with two attorney-mentors for an academic year. For his efforts in this area, he received the Utah State Bar’s 2021 Raymond S. Uno Award for the Advancement of Minorities in the Law.
Engels maintains a healthy civil rights practice through the Firm’s pro bono initiative. Among other matters, he recently sought reform of discriminatory practices at a local police department through a civil rights action under 42 U.S.C. § 1983. He also represented immigrants seeking asylum in the United States’ southern border.
Engels serves on several business leadership roles, including the boards of trustees at Westminster College and the University of Utah S.J. Quinney College of Law, the governing board of Intermountain’s Salt Lake Valley Hospitals, and the Diversity and Inclusion Committee at KUER.
