This will be just the third road crossing east of London. Works were anticipated to start in mid-2022, although the application was withdrawn in November 2020, prior to the Planning Inspectorate issuing a decision that they would not accept the application due to insufficient information
Thurrock Borough Council and Gravesham Borough Council – where the crossing surfaces – have been opponents of the crossing
Following submission to the Secretary of State for examination on 23rd January 2019, the Inspectors concluded in their Final Report, that Tonbridge and Malling’s Local Plan failed the Duty to Cooperate (‘DtC’) and should not be adopted as there was no evidence of the Council having worked with Sevenoaks District Council to address unmet housing need, despite being aware of the scale of the issue. Having considered the Inspectors’ decision, the Council withdrew the Plan on 13th July 2021.
A new Plan is now being progressed following the withdrawal of the previous emerging Plan. The Council is not starting from square one and will continue with the sites in the previous version (as the starting point). The Plan will be a review/refresh of the previous version as opposed to a rewrite. From now until June 2022, the Council is updating its Evidence Base and it is hoped this will address the reasons of the failure of the DtC that the Inspector had concluded.
On 3rd November 2021, an appeal was dismissed by the Secretary of State for an outline planning application for the residential led (1,250 dwellings) redevelopment of land off Pump Lane, Rainham, Kent.One of SoS’s primary reasons given for refusal was the irreversible loss of more than 50 hectares of 'best and most versatile' (BMV) agricultural land which would be a consequence of the development. Although the NPPF does not advocate against the loss of such land, the SoS considered that the loss of significant BMV land , and orchards would have a negative effect on the provision of such land, bringing it into conflict with paragraph 174b) of the Framework. Additionally, the SoS considered that even if the site was not capable of returning a reasonable profit were it to be put to any other agricultural/horticultural or related uses, there was good prospect for the land to be farmed in such a way that realises a reasonable profit.
Adding in changes in the subsidy regime for agricultural land and biodiversity net gain requirements, there are a number of changes in the treatment of agricultural land which will interplay with housing land delivery. [Link to Carter Jonas outlook piece on BNG].
The Stodmarsh National Nature Reserve (NNR) is a 600-hectare Site of Special Scientific Interest (SSSI) located just outside Canterbury. Due to phosphorus and nitrogen issues, there is currently a ‘moratorium’ in place for planning consent for development in the River Stour catchment area. This is holding up the delivery of an estimated 40,000 homes in Ashford, Canterbury and Folkstone and Hyth. This figure does not include housing coming forward in Dover, Maidstone or Thanet, who all also fall within the Stour catchment area.
The aforementioned Councils have asked the government to address the long-term solution by speeding up the upgrades of the Wastewater Treatment Works (WWTW) owned by Southern Water. However, Southern Water is operating within agreed permit levels and as such there is no incentive for them to upgrade or build new WWTWs. The issue is therefore unlikely to be resolved anytime soon without considerable government persuasion.

This phase of Local Plan production takes place following the result of the Inspector(s) examination. Dependent on the outcome, this can involve adoption of the document through the Council’s democratic process; withdrawal of the document from examination (an acknowledgement that the document cannot be adopted); or legal challenge (either against the Inspector(s) judgement and/or the Council’s decision to adopt the document by an interested third party).
Post-Examination
More formally referred to as an Examination in Public (EiP), this phase of Local Plan production involves an examination undertaken by appointed Planning Inspector(s). The document is examined on its legal compliance and soundness, typically through a focus on various issues through hearing sessions and/or written exchanges with interested parties. It can often result in further rounds of consultation, including consideration of new/amended evidence and/or proposed modifications to the document’s content.
To pass the examination, an Inspector(s) is required to publish a ‘final report’ that concludes that the document (inclusive of any modifications) is both sound and legally compliant. The Inspector(s) can choose to recommend that the document is not adopted and/or that the document is withdrawn at any stage.
This is often a lengthy process that typically takes 8-24 months.

This phase of Local Plan production represents the chosen strategy, collection of policies and supporting evidence base that a Council considers is legally compliant and sound.
