The Crown Estate’s portfolio makes up around 55% of the total coastline of England and includes some of the country's largest ports and prime marinas, as well as energy infrastructure, boat yards, wharfs, jetties and moorings.
Our involvement: Across the estate, we advise on matters across the portfolios, which includes strategy, lease and licence agreements, boundary disputes, consenting process, encroachments, maintenance and capital projects, health and safety, budgeting, rent accounting and much more.
In Kent and the rest of the South East, Rachel Wylde and Erin Cousins-Amor have extensive knowledge of the coastal portfolio having managed it for many years along with the coastal portfolio for Southern England. Gatwick Airport Station upgrade
The Carter Jonas Infrastructures team has been advising Network Rail on a £249 million project to upgrade Gatwick Airport Station since 2019.
We have worked on behalf of Network Rail on this landmark development, dealing with the negotiations for acquisition of land and rights from Gatwick Airport Ltd, working closely with the wider project team. The new station facilities, which offer a much-improved passenger user experience, consist of a new main entrance into the south terminal building along with new gatelines, ticketing hall, five lifts and eight escalators.
As well as carrying out an initial exercise valuing land owned by Gatwick Airport Ltd to assist in negotiations, we agreed terms for the associated access rights, utilities easements and land acquisition including for the back of house operations building that sits adjacent to the station.

The Carter Jonas Infrastructure team has acted for Kent County Council since being awarded a framework contract in 2019.
As a full service property consultancy we offer a comprehensive one stop shop service to the client, bringing in support from other divisions within the Carter Jonas business where required.
In Kent particularly, we are instructed in a number of projects including highways improvements at A28 Birchington, A28 Chart Road and A28 Sturry Link in Canterbury as well as providing advice on the development of new transport projects including Dover Fastrack . We are also assisting the council with negotiation of Part 1 claims relating to previous projects at Lower Road and Rathmore Road, Gravesend.

Southern Water
We are instructed in a number of projects for Southern Water, including a bulk supply transfer water main in Kent linking two reservoirs owned by South East Water and Southern Water. The project will allow Southern Water to boost its own supply network by transferring raw water from a reservoir in the South East Water catchment to a reservoir in its own area to provide flexibility in supply during drought conditions. The forming of bulk transfer agreements is a key theme of water companies' Water Resources Management Plan.
Our scoping work has included referencing land ownership and initial landowner engagement. Our infrastructures south team arranged initial walkover surveys using Southern Water’s powers of entry under the Water Industry Act 1991 where needed. These initial surveys have helped define a very tricky route that crosses many archaeological and historical features specific to the Kent weald.
These features include the site of crashed WW2 German aircraft, a cold war nuclear fallout monitoring bunker and land used for WW1 trench digging practice. The WW2 aircraft crash site falls within agricultural land but is protected by the Protection of Military Remains Act 1986. Therefore, consent must be sought from the Ministry of Defence before carrying out any works or excavations in the vicinity of the site.

Continuing the theme of wartime historical features, there are WW1 practice trenches which, although not protected by a specific scheduled ancient monument, are significant archaeological features which could present risk in terms of unearthing unexploded ordnance. We have worked with our client and their engineering and archaeology advisers and landowners to determine a route that mitigates such risks. At the same time, we have identified key areas of reinstatement.
There is also a directionally drilled element beneath the main A2, safe access to required areas of land either side of the road to facilitate the drilling operation is critical.
The infrastructures team has attended numerous site visits with landowners to discuss the route requirements on their land. We have worked with landowners and their agent to understand where altering the route provides benefits to both the landowner, through avoiding a potential development site, and to Southern Water through avoiding the archaeological features mentioned above. This also helps mitigate the potential for significant claims for losses arising from the construction phase.

We are now working with our client to finalise route design and provide advice as to likely heads of claim for compensation that will arise in order to further refine routing options.
As a full-service property consultancy, we offer a comprehensive one stop shop service to the client. Our Infrastructures South team operates from the Maidstone, London and Winchester offices, and resources the entire Southern Water supply region from Hampshire through to Kent. Our Commercial team provides services to Southern Water estates management and corporate strategy teams, and our telecoms and energy teams have provided advice on specialist instructions. We have also acted for Southern Water on two compulsory purchase cases where land is being acquired from them by other acquiring authorities.

Management of the Snodland Estate
The portfolio: The Snodland Estate is a 3,000-acre estate in Kent, jointly owned by Tarmac and Aggregate Industries, purchased in order to quarry in the future. There are various tenants of different types across the estate
Our role: We provide a complete estate management role, including managing all the land and properties.
We also provide enhanced estate management work for other estates in Tarmac’s ownership, including 1,000 acres in Hatfield. Prior to taking on these managements we had, for many years, provided adhoc consultancy work, including tenancy reviews and management of capital works, plus a biannual strategic overview.

Management of the Otterden Estate
One future project is the restoration of the main house on the Estate which extends to approximately 21,000 sq. ft. and requires significant investment and funding to enable occupation of the property. Future plans for the house are being considered at present, but will remain on hold until funding or investment can be found. Our building surveyors and planners will play a fundamental role in the restoration of this property.

The portfolio: The Otterden Estate extends to approximately 2,000 acres, made up of arable, grassland and woodland with two working farms and multiple smaller land parcels let on AHA and FBT arrangements. There is also a principal house on the Estate, and circa. 30 residential properties.
Our role: Not only does Carter Jonas manage the day to day running of the Estate, but manages any sales or re-lettings of land or residential properties on the Estate, advises on stewardship opportunities, manages property repairs and renovations and advises on planning regulations.
In recent years, we have negotiated a tenancy re-organisation on the main farm the Estate, whereby son was brought into the business in return for the surrender of the AHA agreement, and the granting of a long term FBT with residential properties being removed from the farm tenancy. This arrangement secured the future of son to the tenancy, and also provided additional income to the Estate. Both parties were very happy with the agreement reached.

We have also recently secured a Higher Tier Parkland Restoration scheme for the Parkland at Otterden, which secures funding for both capital and management options across the park over the next five years. Some options include the creation of traditional orchards, the creation of species rich grassland, veteran tree survey works and restoration of woodland pasture and parkland. The scheme is essential to enabling works to veteran trees to take place, as well as creating new hedgerows and planting of trees within the park to replace those that have failed over recent decades.
A current project is a new emergency telecoms mast proposed to be positioned on the Estate. We have received and reviewed Heads of Terms and, following our request for evidence to confirm that he mast will not be seen from the main house, we are likely to be moving forward with negotiating the proposed Heads of Terms for the mast and accompanying lease, subject to planning.

Sale of Bog Farm
Bog Farm is a ring-fenced block of about 30 acres (12 ha) of permanent pasture located to the south east of the village of Smeeth. In addition, there are areas of mature broadleaved woodland and a stream to the east the land could be suitable for grazing as well as a variety of amenity and habitat led uses. In all extending to about 67.51 acres (27.32 hectares).
We marketed the farm at a guide price of £425,000 in 2023, and sold it as a whole by private treaty in excess of this figure.

Aylesham South
How we helped: Planning Consultancy and Promotion Agreement
Carter Jonas has successfully secured a draft site allocation directly to the south of the existing settlement of Aylesham and will work with Axis Land Partnerships to deliver an outline planning permission.
Located to the South of the existing settlement of Aylesham, Carter Jonas has worked with the landowner to promote the 62 hectare site via the Local Plan process for well over a decade. We provided Dover District Council with the evidence to demonstrate that the site could accommodate a new neighbourhood of 640 dwellings which resulted in a draft site allocation in the emerging Local Plan. In October 2022, Carter Jonas facilitated a promotion agreement between the landowner and Axis Land Partnerships. We represented Axis Land Partnerships at the Dover Local Plan’s Examination in Public in November 2023 and we are coordinating the preparation of an outline planning application which will be submitted once the new Local Plan has been adopted.
As well as 640 new dwellings, the site would be designed via garden village principles to deliver employment opportunities, community facilities and a convenience store as well as formal and informal open space and various offsite highways improvements. The site represents an important opportunity to add to the success of Aylesham in delivering much needed housing in Dover District

Canterbury Riverside, Kent
The Council and Linkcity worked in partnership to prepare a planning application for the site and an application was submitted. Planning permission for the development of a five screen Curzon cinema, 40,000 sq ft of restaurant, bar and retail space, 490 student bedrooms, 189 homes and a 250-space basement car park was then granted. A compulsory purchase order was made and confirmed.
During this time, the scheme faced viability challenges resulting from additional abnormal development costs and difficult market conditions in the retail and leisure market. Our professionals advised on restructuring of the development agreement and a forward funding of the cinema and commercial leisure element of the scheme by the Council. A Red Book valuation of the site was provided as part of the Council’s ‘Best Consideration’ procedures for site disposal. This restructuring of the scheme allowed it to move forward with the CPO being implemented.
Construction commenced in January 2020 and the scheme opened in Summer 2022. Our professionals also acted as the ‘Council’s representative’ monitoring the construction progress.

Our development professionals have been advising Canterbury City Council on the development of land at Kingsmead, on the edge of Canterbury city centre, for over six years.
The Council’s objectives for the former coach park and depot site were for the development of a leisure-led mixed-use scheme, including a cinema, restaurants, retail and residential uses.
The site is mainly Council owned, but also includes some land owned by third parties. It is located in a sensitive area adjacent to the River Stour and in the viewing corridor for Canterbury Cathedral, a World Heritage site. There are a number of listed buildings immediately adjacent to the site.
Following feasibility and viability advice and market testing, we led a marketing and developer procurement process via the EU Negotiated Procedure. A preferred bidder, Bouygues Developments (now Linkcity), was selected and a development agreement signed.

How we helped: Masterplanning, Planning consultancy
Carter Jonas masterplanning, planning and development teams have acted on behalf of promoter and developer Shaptor Capital over a three year period to progress proposals for a new garden village scale development close to Canterbury and Faversham in the Swale Borough of Kent.
The 2,000+ home settlement will sit adjacent to two existing villages, Boughton-Under-Blean and Dunkirk, with direct access provided via a new junction off the A2 highway. The junction proposals include integrated cycleways and footways between villages enabling improved access across the highway corridor which currently severs north-south movement.
The new village will bring major benefits to the local area, including a GP Surgery, a Primary School and Early Years Centre, a work hub, 50,000sqft of commercial employment space, a sports hub, retail and leisure facilities. Around 40% of the landholding will become public open space, utilising an established network of PRoW and Bridleways to provide access for residents to the wider countryside. The development will seek to achieve BREEAM Excellent for all non-residential buildings, a biodiversity net gain of up to 20%, with off-site mitigation proposed to deal with the Stodmarsh neutrient neutrality issues.

How we helped: Planning Consultancy and Expert Witness
Carter Jonas has secured planning permission for major regeneration in Woking Town Centre for EcoWorld London. The regeneration scheme, originally recommended for approval by officers but ultimately secured following a public inquiry, will create over 900 new homes (including affordable housing), ground floor units for a variety of businesses, a homeless shelter for local charity the York Road Project and a new home for the Woking Railway Athletic Club. The development, designed by JTP, features tall buildings up to 37-storeys adding to Woking’s emerging tall building skyline.
A pedestrianised ‘green’ street is at the centre of the scheme and will feature accessible public space, substantial planting and play features surrounded by new shops and cafés. New pedestrian and cycle connections will be created to encourage greener travel. Additionally, the scheme will provide 1,000 secure cycle spaces, a public cycle repair station and public cycle parking within the landscaped areas.
Approximately 250 local jobs will be created by the development. EcoWorld London will invest more than £10m in local infrastructure and it is anticipated that the scheme will result in a £7m pa increase in local spend in the town.

Carter Jonas’ development team were initially asked to investigate the potential for marketing a joint venture between Hastings Borough Council (as landowners) and a developer, through the OJEU process. At interview, our development professionals expressed reservations about this being the best way forward due to the cost of the OJEU process, the uncertainty of site constraints, and the weak local market.
Following this, our masterplanning team were appointed to prepare the masterplan for the site, which has lain empty for over 30 years. Our approach was to work with the constraints rather than against them, to minimise abnormal costs through clever design.
Two residential schemes for up to 224 dwellings were developed based on four key design elements:
• A central square over the undevelopable wastewater reservoir and adjacent services
• A retained seafront walkway/cycleway enclosed by potential artists’ colony and display space
• Informal timber townhouses in the west
• A more formal residential development in the east.

Our professionals are advising Hastings Borough Council on the sale and development of land at West Marina, West St Leonards, a rare coastal site to the west of Hastings town centre.
Our development specialists were initially asked to investigate the potential for marketing a joint venture, however through a soft market exercise it was agreed that we would proceed with finding a development partner through open marketing.
Our masterplanning team additionally undertook a study on the development potential of the site, which would provide significant regeneration in the area.
The 5.5 acre former pool site was brought forward as a mixed-use redevelopment opportunity with potential for over 100 residential units as well as commercial and leisure uses.
Our professionals led the marketing process. Several rounds of bidding and presentations were carried out with bidders in order to select a preferred developer who could deliver the council’s vision of the site and add significant value and important regeneration.
Following the evaluation of offers received, a preferred developer was chosen. Our professionals then provided full reports to the council on the bid analysis and progress of the disposal.

Carter Jonas on behalf of Vanbrugh Estates and Muse Developments promoted the site through the Runnymede LocalPlan for its release from its Green Belt designation.
Following submission ofrepresentations, Carter Jonas attended the Examination in Public on behalf of the clients andthe Local Plan was adopted in Summer 2020 with the site allocated for 220 residential units.
During the Local Plan preparation, a planning application was submitted in accordance with the draft allocation requirements and is awaiting determination of the Local Planning Authority.
The site’s proximity to the M25 motorway and subsequent considerations for air quality and noise mitigation were key matters for consideration when developing an argument to maximise the site’s capacity.
