There will always be a place for formal adversarial processes in the resolution of complex technology disputes. However, we can also expect greater adoption of streamlined processes and new forms of dispute resolution are likely to be required to resolve disputes arising from the use of new and emerging forms of technology.
Technology transformation:
Despite these risks, businesses feel an imperative to deploy new forms of technology to maintain their market position and need to take steps to understand and mitigate the risks.
Respondents anticipate an increase in disputes arising from new forms of technology – AI (56%), smart contracts (55%) and crypto currencies (52%) – as well as IP and trade secrets (62%).
50% of survey respondents believe that the use of AI will give rise to risks and disputes that cannot be foreseen at the time of adoption of the technology.
