With pressure continuing to build on low tax, low substance IP locations from the Tax Cuts and Jobs Act and the OECD’s Base Erosion and Profit Shifting (BEPS) initiative, many companies are contemplating migrating their IP holding structures to locations where they have more substance. For some, this may mean onshoring to non-U.S. locations (Ireland, Singapore, Netherlands, UK, among others), or alternatively, repatriating IP to the United States.
