The Biden Administration has unveiled new measures aimed at helping certain individuals in the U.S. find a more durable immigration path. One of these measures involves granting “Parole in Place,” which allows qualifying individuals to secure family-based immigrant visas through their marriage to a U.S. citizen.
Since the eligibility criteria involves the method of entry, this relief could potentially apply to a range of individuals, including Deferred Action for Childhood Arrivals (DACA) recipients, asylum seekers and TPS beneficiaries.
Fragomen’s HELP Practice Group can assist individuals and employers in determining who may be eligible for this new “Parole in Place” relief. Fragomen is developing a tool to help you understand whether Parole in Place might be right for you. Check back soon for access to the tool.

crises—from political turmoil to climate change—knowledgeable immigration support is critical for both
employers and their employees.
Fragomen’s Humanitarian and Evolving Legal Pathways (HELP) Practice Group assists employers with humanitarian issues impacting their workforces and large-scale immigration crises. We advise employers on issues such as asylum, parole and Temporary Protected Status (TPS), and how to use these pathways to move employees out of danger and into stable working arrangements.
Our attorneys and professionals are steeped in every facet of humanitarian immigration law. We understand how humanitarian pathways interact with employment-based visa options, allowing us to provide employers with comprehensive counsel on immigration options for their crisis-impacted employees.
Preparing for
the Potential
End of DACA
The Deferred Action for Childhood Arrivals program is currently in a vulnerable position. The DACA program has been challenged in the courts and could end soon, regardless of the outcome of the upcoming presidential election.
If you employ DACA recipients, or believe you might, now is the time to prepare. Our HELP Practice Group will get you up to speed on the possible cancellation of DACA and assist with identifying the "Dreamers" in your workforce.
We’ll identify alternative work authorization options for your DACA employees, developing a flexible approach that aims to create the best results possible.
