The H-1B visa is granted in three-year increments, with a maximum six cumulative years, for nonimmigrant professional workers employed in a specialty occupation. One- or three-year extensions beyond six cumulative years may be granted in certain circumstances. The H-1B1 and E-3 are also non-immigrant visas based on the Free Trade Agreement for workers in a specialty occupation from Chile and Singapore (H-1B1) and Australia (E-3). The H-1B1 and E-3 are not subject to the H-1B CAP lottery and can be applied for at the US Consulate abroad or by filing a petition with USCIS depending on the circumstances.
The L-1 visa is used for intracompany transfers from an organization’s entity abroad transferring to the US for positions that are either managerial or require specialized knowledge. The individual should have at least one (1) year tenure with the entity abroad prior to transferring to the US. The L-1A nonimmigrant classification enables a US employer to transfer an executive or manager from one of its affiliated foreign offices to one of its offices in the US. The L-1B nonimmigrant classification enables a US employer to transfer a professional employee with specialized knowledge relating to the organization’s interests from one of its affiliated foreign offices to one of its offices in the US.

The O-1 nonimmigrant visa is for the individual who possesses extraordinary ability in the sciences, arts, education, business, or athletics, or who has a demonstrated record of extraordinary achievement in the motion picture or television industry and has been recognized nationally or internationally for those achievements.
O-1
The EB-1 is an employment-based green card preference category, which may be a great strategy depending on the individual’s qualifications. EB-1 preference category includes immigrant petitions for workers with extraordinary abilities, outstanding researcher, and multinational manager. Our attorneys are also well-versed in other employment-based green card processes, including National Interest Waiver and PERM.

The PERM process includes a Department of Labor certification required for US employers to sponsor an employment-based green card process for employees where a test of the labor market was performed and for which qualified authorized workers are unavailable in the US.

The TN nonimmigrant visa enables qualified Canadian and Mexican citizens to work on professional business activities for a set period of time.
