The consultation must be undertaken at a stage where the proposals are at a formative stage and not when Ofcom has already decided what course it will adopt.
Formative stage of proposals
The consultation must enable consultees to intelligently consider the proposals and respond. Practically this means that the information should be clear, concise and sufficiently reasoned, and the questions asked should be ones that consultees can sensibly answer. Where relevant it can also require disclosure of data/modelling.
Intelligent consideration and response
The consultation should provide adequate time for the response.
Adequate time for responses
The product of a consultation must be conscientiously taken into account when finalising proposals.
