The H-1B visa transfer process can take anywhere from one to six months. You can transfer your visa an unlimited number of times. However, it is only available to use for a total of six years. You are allowed to work for the new sponsoring company while the transfer is in process, if desired.
When you partner with Kforce for your H-1B visa transfer, you will have an individual point of contact who will work with you throughout the entire process. Once you receive an offer from one of our clients, we begin the transfer process by collecting all required documents and compiling the information, which is then sent to our third-party attorney, the third largest immigration firm in the country, for further processing. The attorney reviews the documents, completes the application requirements and submits the entire packet to USCIS for review. Once USCIS approves the case, you will receive an approval notice. If USCIS requires further documentation, we will receive a Request for Evidence (RFE) to collect additional documentation.
If you’re entering the U.S. as an international student, you will most likely be using the F1 visa status.
There are three different work authorization status types:
• Curricular Practical Training (CPT)— employed while attending school; managed by the school
• Optional Practical Training (OPT)— Post-graduation status that is valid for a 12-month duration and requires an EAD card
• OPT STEM—grants an additional two years for those who graduated with a qualifying STEM degree, after the OPT 12-month period for a total of three years post-graduate work.
These status types enable you to work for any employer until reaching the end of your 12-month OPT expiration date, depending on the guidelines and requirements for each situation. To be eligible to extend your OPT status to OPT STEM, you must work with an e-Verify employer. As an e-Verify employer, Kforce can help with your EAD extension. We have developed a specific curriculum to meet all I-983 requirements, which we have used with a 99% success rate since the inception of the program.
The green card process is one of the most important aspects of any potential employer’s capabilities. While the H-1B visa is the most prominent visa for the IT foreign born population, its finite timeframe for use makes the green card process extremely valuable if you’re approaching the six-year maximum expiration date.
The green card process is comprised of various stages and can bring challenges along the way. It’s important to note:
• Not every company that sponsors H-1B visas also sponsors green cards
• Most companies that sponsor green cards do not have a satisfactory approval rate
• Most companies that sponsor green cards wait at least 12 months before they begin the process
