The U.S. Supreme Court ruled unanimously in favor of Cox Communications, rejecting an expansion of copyright contributory liability for platforms. Its impact will be immediate and far-reaching, providing freedom to operate for generations for AI and tech innovators.
In a win that earned American Lawyer Litigators of the Week top honors, the California Supreme Court has ruled for Gilead Sciences, rejecting a first-of-its-kind “duty to innovate” theory of product liability and eliminating nearly 23,000 cases before a single trial. This case presented an existential threat to the innovator’s model of incremental improvement and would have upended product liability as we know it. 70 amici, including leading innovators across the life sciences, automotive, manufacturing, tech and retail industries, signed on to support Gilead’s position.
